Terms & Conditions
These Terms & Conditions ("Terms") govern your use of The Solution, a hospitality operations platform (the "Service") provided by The Solution ("we", "us", "our"). By creating an account or continuing to use the Service, you agree to these Terms.
1. Who you are contracting with
The Service is provided by The Solution. You must have authority to bind your business (if signing up on behalf of one) and be of legal age to enter into a contract.
2. The Service
The Solution provides point-of-sale, inventory, menu costing, sales reporting and rota planning tools for cafes and restaurants. Features may change over time. We do not guarantee uninterrupted or error-free operation.
3. Your account
You are responsible for maintaining the confidentiality of your login credentials and PINs, and for all activity under your account. You must provide accurate information and keep it up to date.
4. Acceptable use
You agree not to misuse the Service. In particular, you must not: (a) use the Service unlawfully or for fraud or spam; (b) infringe intellectual property or privacy rights of others; (c) interfere with security, probe, scan, scrape, or introduce malware; (d) reverse engineer, resell, redistribute, or circumvent technical limits of the Service.
5. Intellectual property
We retain all rights, title and interest in the Service, including software, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your subscription plan. You retain ownership of the content and data you enter; you grant us a limited licence to host and process it solely to provide the Service.
6. Payment, subscriptions, taxes and refunds
Our order process is conducted by Stripe. Stripe is the Merchant of Record for our orders and handles billing enquiries, taxes and returns.
Subscriptions renew automatically on a monthly basis until cancelled. Payment, billing, taxes, cancellations and refund mechanics are handled by Stripe and are governed by the Stripe consumer terms. See our Refund Policy for details.
7. Suspension and termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, you may export your data for a reasonable period; after that, we may delete it.
8. Warranties and liability
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability is limited to the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data or goodwill. Nothing in these Terms excludes liability for fraud, death or personal injury where such exclusion is prohibited by law.
9. Indemnity
You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your violation of these Terms.
10. Governing law
These Terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of England and Wales.
11. Changes and assignment
We may update these Terms from time to time; material changes will be notified in-app or by email. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
12. Force majeure
Neither party is liable for failure to perform due to events beyond reasonable control.
